Terms and Conditions
By signing and submitting the Booking Form you agree to the following terms and conditions.
The Agreement
The terms and conditions set forth in this agreement (“Terms and Conditions” or “agreement”) constitute the entire understanding and agreement between you the trip participant (“Participant”) and Aspirar Tours, LLC (“Aspirar,” “we,” or “us”) with respect to any and all bookings, tours or transactions made with us.. By signing this agreement, you accept all of the terms in this agreement and direct us to perform services on your behalf. All trips that we offer are subject to these terms and conditions, our waiver of liability and assumption of risk and indemnity agreement, and the itineraries and invoices pertaining to the trip. The terms of this agreement are contained solely in this document, the release form, and the booking form.
Aspirar reserves the right to terminate the contract with the Participant if the behavior or conduct of the Participant or any person listed on his/her Booking Form either prior to or during the trip is likely to endanger the safety or well being of other Participants in his company or that of the Participant himself, or that of the Participant’s representatives, contractors, agents or employees and the cancellation charges as provided for in this Booking Form are payable by the Participant, whereas a result of the Participant’s actions or the actions of any other person who is listed on his/her Booking Form, either or both of the following incidents occur:
Fitness and Disabled Persons
By signing this agreement the Participant assumes responsibility for ensuring they have the appropriate fitness level to complete the pilgrimage safely. In good faith we provide detailed stage length and degree of ascent and descent. If the Participant cannot follow the designed route or makes any changes to the route during the trip the Participant will be responsible for any additional costs incurred to complete the route described in the orientation material.
It is the Participant’s responsibility to disclose to us any physical or mental condition of a member of their party which may affect the Participant or a member of their party from safely participating in and completing the trip. We reserve the right to decline a booking if in the opinion of Aspirar the trip would not be appropriate for a disabled person.
Booking and Payment
Booking is made by signing this agreement on behalf of yourself and all Participants named in your booking and by paying a deposit of 25% of the value of the trip. The booking is accepted when we provide written confirmation by email. If a booking is not accepted you will be informed in writing and the deposit will be fully refunded. Travel insurance, including medical coverage, is not included in the price of the trip but is a condition of booking.
The full amount of the trip must be paid at least 90 days before the tour begins. Aspirar, LLC reserves the right to cancel the booking if payment is not made by that date. To secure a booking a non-refundable deposit of 25% is required. The following charges will be made in the event of a cancellation:
Substitution/Transfer: If the participant is prevented from proceeding with the tour, he/she may transfer the booking to a person who satisfies all the conditions required. Transfer notices must be given in writing to Aspirar, LLC Tours at least 60 days prior to the departure date. The transferee must complete and sign a booking form and comply with any other requirements applicable to the tour. Cancellation policies apply to the transferee and the participant making the transfer..
Room Arrangements
All prices are quoted on the basis of two persons per room. Single room accommodation is limited and may not always be available, and will incur a single room supplement fee. If you are traveling alone but wish to share, notify us at booking and we shall endeavor to find a suitable traveling companion. If we are unable to find someone, we will allocate you a single room and charge you only half the applicable single room supplement stated in the brochure. In this instance, a separate invoice will be issued 30 days before departure with the single room supplement fee.
Aspirar’s Responsibility
We provide competent, reliable and qualified suppliers based on information that is available to us at the time of the booking. However, Aspirar acts only as an intermediary for the various independent suppliers that provide lodging, meals, transportation, luggage transfer, activities or other goods and services connected with your trip. You acknowledge that you are aware and clearly understand that these suppliers are independent contractors, are not managed by us, and are not agents or employees of Aspirar. A supplier’s services are subject to the supplier’s own terms and conditions and any applicable local laws, regulations and treaties of the relevant country.
Alterations Made by Aspirar
We plan our trips many months in advance. At times, we have to change or cancel lodging or other aspects of a trip due to unforeseen circumstances. We strive to operate all tours as advertised, but we do reserve the right to modify or cancel any accommodation or other trip details at any time. Most changes, if they occur at all, will be minor. If there are significant changes (i.e. a major alteration to the route) we will inform you of the change when you book, or if you have already booked, prior to your departure as long as we have sufficient time to inform you.
If there are significant changes to the itinerary, you then have the following options:
Change Request
If the Participant wishes to make changes in the booking (i.e. room sharing), the request must be made in writing by email at least 30 days prior to the start of the trip and may incur a fee. The type and scope of any change dictates the amount of the change fee. If a change request alters the services provided by an outside supplier, additional charges may be made for which the Participant is responsible. Change requests made during a trip may not be possible, although we will make a reasonable effort to accommodate the request. Any additional cost that arises from a change after the trip commences will be paid by the Participant.
Luggage Transfer
Luggage transfer costs are included in the trip fee. The Participant agrees to the following terms related to luggage transfer.
Participant’s Responsibility
By signing this booking agreement, the Participant agrees to the following.
Complaints
If you have a complaint during your tour, you must promptly report it to either your tour leader or to Aspirar. Failure to do so while you are on the tour will negate a claim for any compensation from Aspirar in the event that prompt reporting would have allowed us to fully or partially resolve the complaint at that time. Complaints must be received in writing by Aspirar within 30 days after the end date of the trip.
Liability
Aspirar Tours, LLC will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure.
“Force Majeure” means any circumstances beyond our reasonable control, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, storm, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, illness, quarantine, government intervention, weather conditions, and unforeseen circumstances. If we and any of our suppliers are affected by Force Majeure, we and our suppliers shall be entitled to, and may in our sole discretion, vary or cancel any itinerary or arrangement in relation to the tour.
Aspirar shall not be liable for any damage caused to the Participant by the failure to perform the contract or the improper performance of the contract where the failure or the improper performance is due neither to any fault of Aspirar or any supplier acting on our behalf nor to that of another supplier of services, or for (a) failures which occur in the performance of the contract are attributable to the actions of the Participant; or
(b) failures attributable to any third parties unconnected with the provision of the services contracted for, with whom the Participant makes individual direct arrangements.
Limitation of Remedies
To the maximum extent permitted under applicable law, Aspirar Tours, LLC shall not be liable for any special, consequential, indirect, incidental or other damages arising out of or in any way connected to this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Aspirar Tours, LLC has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages. Aspirar Tours, LLC’s maximum liability in the event of default will be limited to the amount paid to Lightline Pilgrimages NA, LLC’s for its services.
Governing Law Jurisdiction
This agreement will be interpreted according to the laws of the State of Texas, USA. Jurisdiction over any dispute arising out of, in connection with, or relating to this agreement and/or the transactions and relationships among the parties contemplated by this agreement shall be filed exclusively in state, local or federal courts in Plano, Collin County, Texas. You agree to personal jurisdiction in the specified forum.
